Your ID Card
STOP ASKING ME QUESTIONS To: Law Enforcement Officer. Right now I am seeking to protect and
exercise my rights as a U.S. citizen. With respect to any possible legal
action this printed card (a "document") you are now reading is evidence,
so keep this document as evidence. File it properly. Do not misplace it
or give it back to me, I have lots of copies. You may assert you have a
"reasonable suspicion" or "probable cause" to stop and detain me. Truthfully
tell me related facts and details now. U.S. citizens are legally not required
to pass a law enforcement respect test, an attitude test, a fashion test.
Do not claim that I appear "agitated" to you. Do not claim I am now obstructing
and delaying a police investigation. While detained by you or in any setting
in which my freedom of action is curtailed in any significant way I shall
not be compelled to answer questions. I understand that anything I may
say now can be used against me in a police report and/or in court. Thus,
I hereby DO NOT give up my right to remain silent. Your conduct now ought
to be governed by the Fourth and Fifth Amendment to the U.S. Constitution
and related case law. I have no duty to speak. You may be commanding me
to "identify myself." You may be seeking Identity Information from me.
You may have a right to do that. You have no right to compel me to speak
or to answer, including during custodial interrogation. You may ask, but
as a detainee I am not obliged to respond. My refusal to answer furnishes
no basis for arrest. My name is printed below on this document, and by
now you may already have my valid California Drivers License with my name
and photo on it in your possession -- please give it back to me now. Thus,
I have provided Identity Information to you. STOP the questions. Tell me
that I am now free to go or stay as I may elect. If not, understand that
I now have the right to have an attorney present. I hereby ask for an attorney
to be present. Immediately cease your interrogation of me. Do not search
for anything, anywhere. I understand that you may be allowed to use
force, stealth, deception, threats and coercive interrogation methods.
Stop it. Do not plant any evidence. Do not make any false statements or
misrepresentations of fact in a police report, if any. Provide your business
card to me, and/or write down your name and badge number on a card and
give it to me and include the date, time, location and the facts and details
about why you have stopped and detained me. If there are associates with
me, do not compel them to leave the vicinity. They have a right to be here.
They may serve as witnesses to your conduct, and may be willing to testify
on my behalf under oath in a court of law. I waive no rights or privileges
under the U.S. Constitution, Federal Law, the State Constitution and /
or State Law. I am a U.S. Citizen • Born in the USA before 9/11 • YOUR
NAME
It may be helpful to keep copies of a written statement
similar to this with you to present to law enforcement officers when stopped
and questioned.
